Sparniukas.lt E-shop rules


  1. General Provisions

  2. The rules of the Sparniukas.lt online store (hereinafter - the Store) (hereinafter - the Rules) apply to the Client when placing an order in the Sparniukas.lt Store.
  3. Sparniukas.lt has the right to adjust the Store Rules. When the Client shops in the Store, the Rules valid at the time of placing the order (indicated next to the order) apply.
  4. The Client is not given the opportunity to place an order for goods in the Sparniukas.lt Store if they are not familiar with the Store Rules. In all cases, it is considered that the Client is familiar with and approves the Rules if, before ordering goods, they confirm their approval of the Rules by clicking "I AGREE". In cases where the Client partially or completely disagrees with all or a certain part of the Rules, they must not place an order electronically with Sparniukas.lt, otherwise, it is considered that the Client has read and unconditionally agreed to all Store Rules.
  5. Sparniukas.lt is released from any liability in cases where losses arise due to the Client, disregarding the recommendations provided and their obligations, not having familiarized themselves with the Store Rules, although such an opportunity was provided to them.

 

  1. Privacy Policy

  2. If the Client wishes to receive informational messages from Sparniukas.lt, they are given the option to choose to have such messages sent to them.
  3. A cookie is a small text file sent to the device of every person visiting the website, from which they connect to the website, and temporarily stored on that device. During the next visit to the website, your browser will read the cookie and transmit the information back to the website or element. The information collected by cookies on the website helps to identify the website visitor, save the browsing history on the website, and adapt the content accordingly. Cookies on the Sparniukas.lt website are intended for:
    o Ensuring consistent website functionality
    o Ensuring shopping cart functionality
    o Reminding about liked products
    o Collecting page visit statistics
    To delete all cookies stored on your computer, please refer to the instructions of your browser manufacturer, which you can find in the browser menu by clicking "Help".

  4. When the Client orders goods, the personal data necessary for the delivery of the goods must be provided: name; surname; address to which the goods will be delivered; phone number; other data necessary for delivery. Sparniukas.lt confirms that such data will be used exclusively for the purposes of ordering and delivering goods. Sparniukas.lt undertakes not to disclose such information to third parties, except for Sparniukas.lt partners providing goods delivery or other services related to the Client's order placement or execution. Any other exceptions to the disclosure of the Client's personal information to third parties are always coordinated with the Client. In all other cases, any personal data of the Client may be disclosed to third parties only in cases provided for by the laws of the Republic of Lithuania.
  5. 4. By familiarizing themselves with the Rules, the Client confirms that they are informed that when browsing the Sparniukas.lt Store, cookie files (files sent from the internet server) will be placed on their computer.

 

III. Order placement procedure and conditions


  1. The Client visits the Store's website and selects the goods they like. A shopping cart is formed based on their selection.
  2. After forming the shopping cart, the Client must enter the data necessary for the delivery of the selected goods: their name, surname, address to which the goods will be delivered, phone number, and additional information that may be important for the delivery of the ordered goods. Sparniukas.lt confirms that the data provided by the Client will be used exclusively for the purposes of selling and delivering goods, without violating the requirements for personal data protection established by the laws of the Republic of Lithuania.
  3. Next, the Client must choose one of the available payment methods in the Sparniukas.lt Store (more details in Section IV of the Rules). At the same time, a goods delivery method can be chosen from the available Sparniukas.lt delivery options.
  4. In the last window, all data provided by the Client is generated, before confirming which, the Client must ensure that the provided data is correct and corresponds to their wishes. The Client has the opportunity to correct incorrect data before sending the order to Sparniukas.lt. The Client is also given the opportunity to correct personal data necessary for goods delivery after the order has been placed. The Client is not given the opportunity to confirm the order until they indicate that they are familiar with and agree to the Sparniukas.lt Store Rules. In the event that the Client is not familiar with the Store Rules before selecting the goods, they must do so before confirming their order and the data provided therein.
  5. Once the Client confirms the order, it is sent to Sparniukas.lt. The order is considered placed from the moment Sparniukas.lt receives it. At the same time, in such a case, it is considered that a contract has been concluded between the Client and Sparniukas.lt. However, such a contract is considered enforceable only from the moment Sparniukas.lt receives confirmation from the Client's chosen bank (when payment via internet banking is selected) about payment for the delivered goods; when payment is made by bank transfer, the contract is considered enforceable.
  6. Once the Client places an order, the Sparniukas.lt system automatically sends the Client an email indicating the ordered goods and the data provided by the Client.
  7. Upon receiving notification from the bank that the Client has made a payment order for goods purchased from the Store, Sparniukas.lt sends a notification to the Client's specified email address. The moment of receiving the notification from the bank is considered the commencement of the performance of the contract between the Client and Sparniukas.lt.
  8. The order placed by the Client is stored in the Sparniukas.lt database in accordance with the requirements of the currently valid laws of the Republic of Lithuania regarding the storage period of such data.
  9. In all cases, it is considered that the Client, by placing an order, is familiar with and unconditionally agrees to all Store Rules, as well as all other conditions indicated with the order.
  10. The contract is concluded and executed in the national language.
  11. Warranties and pricing
  12. The general characteristics of each product are indicated next to each product in the Store.
  13. Sparniukas.lt indicates, and the Client confirms, that they are aware that the goods listed in the Store may not match the actual size, shape, and color of the goods in terms of their color, shape, or other parameters due to the characteristics of the monitor used, and the difference in color between reality and the photo, due to light scattering by photographic equipment.
  14. The Client agrees that, when placing an electronic order in the Store, they undertake to pay the price indicated in the order for the goods.
  15. Prices in the Store and in the order are indicated in the official national currency with VAT.
  16. Sparniukas.lt sells goods that meet the conditions specified in the order. In cases where the goods handed over to the Client do not meet certain order requirements, the Client agrees to first immediately notify Sparniukas.lt by phone or email, and Sparniukas.lt undertakes to take all measures to eliminate existing defects if such defects arose due to Sparniukas.lt or third parties acting on its behalf. If Sparniukas.lt fails to eliminate the defects within a reasonable period agreed with the Client, the Client has the right to defend their rights in the manner provided for in the Civil Code of the Republic of Lithuania.
  17. Sparniukas.lt obligations regarding goods:
    6.1. Sparniukas.lt undertakes to transfer goods of proper quality and meeting the requirements specified in the order.
    6.2. Sparniukas.lt undertakes to provide the Client with the quantity of goods specified in the order. Sparniukas.lt is not responsible in cases where the quantity of transferred goods is not accurate due to the Client incorrectly specifying data in the order submitted to Sparniukas.lt.
    6.3. Sparniukas.lt always provides the Client with a range of goods that meet the criteria specified in the Order.
    6.4. In cases where the order specifies a certain set of items, Sparniukas.lt undertakes to provide all items included in the set.
    6.5. Goods are delivered packaged, taking into account their nature, in order to ensure that the goods are suitable for their intended use.

 

 

  1. Payment procedure and terms

  2. The Client pays for their ordered goods using one of the methods specified in the Sparniukas.lt Store.
  3. If the Client has chosen one of the online payment methods, they undertake to pay for the ordered goods immediately. In other cases, the Client loses the right to make claims regarding delays in goods delivery, as the goods parcel for the Client's order begins to be formed only after Sparniukas.lt receives payment for the goods.

 

  1. Statutory right to withdraw from the contract regarding SPARNIUKAS.LT goods

When you purchase Sparniukas.lt goods, you have a statutory right to withdraw from the contract:

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party designated by you (but not the carrier) received the last item of goods. To exercise your right of withdrawal, you must inform us (MB Sparniukas, Dubysos g 1 Kauno raj. Purviškiu km. 54210, email: info@sparniukas.lt +37060926178) of your decision to withdraw from the contract by sending us a clear statement (e.g., a letter sent by post, or email). If you wish, you can use the attached withdrawal form, but this is not mandatory. If you submit your withdrawal notification online, we will immediately send you an acknowledgment of receipt (e.g., by email). It will be considered that you have complied with the withdrawal period if you send your withdrawal notification before the end of the said period.

  1. Consequences of withdrawal from the contract:

If you withdraw from this contract, we must return all payments received from you, excluding delivery costs, without undue delay, but no later than 14 days from the day we received your notification of withdrawal from this contract. Refunds will be processed using the same payment method you used for the original transaction, unless explicitly agreed otherwise with you. We will not charge you any fees for the refund. We may withhold the refund until we have received the goods back or you have provided us with proof that you have returned the goods, whichever occurs first. You must return or hand over all goods to us without undue delay, but no later than 14 days from the day you provided us with your notification of withdrawal from this contract. The above requirement is considered to be met if you return the goods before the 14-day period expires. You only have to cover any decrease in the value of the goods if the decrease in value is attributable to your improper actions with the goods when checking their condition, properties, and functioning.

(*) Delete as appropriate. The right to withdraw from the contract expires prematurely for contracts concerning packaged goods that were unsealed after delivery and are unsuitable for return due to hygiene reasons.

 

VII. Product Returns


  1. The Client is given the opportunity to exchange the items handed over to them for other similar items of different dimensions, shape, color, model, or completeness, or to return unwanted goods.
  2. The Client can return the goods by sending them back within 14 days, starting from the day after the consumer notified their decision to withdraw from the contract.
  3. Changes to packaging necessary for inspecting the product are not considered significant damage or loss of commercial appearance. In all cases, goods must be returned in their original packaging.
  4. The exchange or return of items is carried out by the Client filling out the established Sparniukas.lt goods return or exchange form.
  5. In cases where goods are exchanged and a price difference arises during such exchange, the Client must pay this price difference to Sparniukas.lt.
  6. In cases where Sparniukas.lt does not have suitable items for exchange, the paid amount is refunded to the Client, excluding the delivery price.
  7. Goods can only be exchanged or returned if they meet the requirements specified in point 3 of this part of the Rules. The paid amount is refunded no later than 14 days from the signing of the return form.
  8. All notifications to the Store must be sent by email to info@sparniukas.lt or by phone at +37060926178. The contract is concluded, executed, and all communication between the Client and the Store takes place in the national language.
  9. Electronic consumer disputes can be resolved on the consumer dispute resolution platform http://ec.europa.eu/odr/
  10. First, after contacting the e-shop, email: info@sparniukas.lt +37060926178, and if no joint solution is reached regarding product non-conformity, return, or exchange, you can submit a request/complaint regarding a product or service purchased in our online store to the State Consumer Rights Protection Authority (Vilniaus g. 25, 01402 Vilnius, email: tarnyba@vvtat.lt, tel. 8 5 262 67 51, fax 8 (5) 279 1466, website www.vvtat.lt (also to the territorial divisions of the State Consumer Rights Protection Authority in the county).

 

VIII. Product Delivery


  1. Sparniukas.lt undertakes to deliver the goods to the Client no later than within 20 working days from the sending of the order fulfillment confirmation to the Client. Such a term does not apply in cases where Sparniukas.lt does not have the required goods in stock, and the Client is informed about the shortage of their ordered goods. At the same time, the Client agrees that in exceptional cases, goods delivery may be delayed due to unforeseen circumstances. In such a case, Sparniukas.lt undertakes to immediately contact the Client and coordinate goods delivery issues.
  2. The Client undertakes, when ordering goods, to specify the place of goods delivery and the person who will accept the goods.
  3. The Client undertakes to accept the goods themselves. In the event that they cannot accept the goods themselves, and the goods are delivered to the specified address and based on other data provided by the Client, the Client has no right to make claims against Sparniukas.lt regarding goods delivery to an unsuitable entity.
  4. Goods ordered in the Sparniukas.lt online store are delivered by an authorized courier service. The Client coordinates the delivery time with the authorized courier service. In cases where the Client cannot accept the goods at the specified time, they undertake to immediately notify the customer service department by email (contact details can be found in the "Contacts" section of the Store).
  5. Due to the Client's fault or circumstances dependent on them, if the authorized courier service was unable to deliver the goods, the courier service additionally coordinates a new delivery time suitable for the Client. Re-delivery is performed no more than twice. If the Client fails to accept the goods three times, the goods are returned to Sparniukas.lt, and the Client has no right to make claims regarding delayed delivery of goods. In addition, Sparniukas.lt is in all cases released from liability for violating goods delivery deadlines if the goods are not delivered to the Client or are delivered late due to the Client's fault or circumstances dependent on the Client.
  • The Client must immediately inform Sparniukas.lt by email:
    a) if, after specifying a time slot for delivery, the shipment is not delivered or the couriers are more than 15 minutes late after the end of the time slot;
    b) if, when contacting the couriers at the specified email address, no response to the inquiry is provided within 4 business hours, or if, when contacting the specified phone number, no response is provided;
    c) if the courier behaves disrespectfully or has an unkempt appearance during delivery;
    d) in all cases, immediately inform Sparniukas.lt if the shipment is delivered in a damaged, crumpled, or otherwise compromised package; as well as in cases where the shipment contains items that were not ordered, or an incorrect quantity of such items, an incomplete set of items, or items of the wrong size or dimensions.
  • In all cases where the shipment package is crumpled, wet, or otherwise externally damaged after the couriers deliver the goods to the Client, the Client must indicate (write comments) in the delivery confirmation provided by the courier or draw up a separate act regarding such defects. The Client must do this in the presence of the courier. Failure to perform such actions releases Sparniukas.lt from liability to the Client for damage to goods if such damage was caused by packaging damage that the Client did not note in the shipment delivery confirmation.
  • In cases where, after receiving the goods, the Client notices that the shipment does not contain the correct set of goods or the delivered goods are not of the correct size, color, or other dimensions, the Client must immediately inform Sparniukas.lt.

    2. All notifications to Sparniukas.lt must be submitted by email to the customer service department (contact details can be found in the "Contacts" section of the Store).
    3. The contract between the Client and Sparniukas.lt is concluded and executed in the state language.
    4. The design and original photos of the Sparniukas.lt website are intellectual property, which may not be used or distributed without consent. The visual content of the Sparniukas.lt website is protected by the copyright and related rights of the Republic of Lithuania.
