Rules of the e-shop Sparniukas.lt

General provisions -
The rules (hereinafter referred to as the Rules) of the Sparniukas.lt online store (hereinafter referred to as the Store) apply to the Customer when placing an order in the Sparniukas.lt Store. - Sparniukas.lt has the right to adjust the Store Rules. When a Customer makes a purchase in the Store, the Rules valid at the time of placing the order apply (indicated with the order).
- The Customer is not given the opportunity to place an order for goods in the Sparniukas.lt Store if he is not familiar with the Store Rules. In all cases, the Customer is considered to be familiar with the Rules and agrees with them if, before ordering the goods, he confirms his agreement to the Rules by clicking "AGREE". In cases where the Customer partially or completely disagrees with all or a certain part of the Rules, he must not place an order electronically in Sparniukas.lt, otherwise it is considered that the Customer has become familiar with and unconditionally agreed with all the Store Rules.
- Sparniukas.lt is exempted from any liability in cases where losses arise due to the fact that the Customer, disregarding the recommendations provided to him and his obligations, did not familiarize himself with the Store Rules, although he was given such an opportunity.
- Privacy Policy

If the client wishes to receive Sparniukas.lt information messages, he is given the opportunity to choose to have such messages sent to him. - A cookie is a small text file that is sent to the device of each person visiting a website from which the website is accessed and is temporarily stored on that device. During the next visit to the website, your browser will read the cookie and transmit the information back to the website or element. The information collected by the cookie on the website helps to recognize the website visitor, save the history of visiting the website and customize the content accordingly. Cookies on the Sparniukas.lt website are intended for:
o Ensure consistent website functionality
o Ensure shopping cart functionality
o Remind you about your favorite products
o Collect page visit statistics
To delete all cookies stored on your computer, please refer to the instructions provided by the manufacturer of the browser you are using, which can be found by clicking "Help" in the browser menu.
Note: If you delete our cookies, you will not be able to use some features of our website. - When ordering goods, the Customer must provide the following personal data necessary for the delivery of the goods: name; surname; address to which the goods will be delivered; telephone number; other data necessary for delivery. Sparniukas.lt confirms that such data will be used exclusively for the purposes of ordering and delivering goods. Sparniukas.lt undertakes not to disclose such information to third parties, except for Sparniukas.lt partners providing delivery of goods or other services related to the submission or fulfillment of the Customer's order. Any other exceptions to the disclosure of the Customer's personal information to third parties are in all cases agreed with the Customer. In all other cases, any personal data of the Customer may be disclosed to third parties only in cases provided for in the legal acts of the Republic of Lithuania.
- 4. By familiarizing themselves with the Rules, the Customer confirms that they are informed that when browsing the Sparniukas.lt Store, cookie files (files sent from the Internet server) will be placed on their computer.
III. Order submission procedure and conditions

The customer, having visited the Store's website, selects the products he likes. Based on his selection, a shopping cart is formed. - After creating a shopping cart, the Customer must enter the data necessary for the delivery of the selected goods: their name, surname, address to which the goods will be delivered, telephone number and additional information that may be important for the delivery of the ordered goods. Sparniukas.lt confirms that the data provided by the Customer will be used exclusively for the purposes of selling and delivering goods, without violating the requirements of the legislation of the Republic of Lithuania for the protection of personal data.
- Next, the Customer must choose one of the available payment methods in the Sparniukas.lt Store (for more information, see Section IV of the Rules). At the same time, the method of delivery of the goods can be selected from the available Sparniukas.lt delivery methods.
- The last window generates all the data provided by the Customer, before confirming which the Customer must make sure that the data provided is correct and meets his/her wishes. The Customer has the opportunity to correct incorrect data before sending the order to Sparniukas.lt. The Customer is also given the opportunity to correct personal data necessary for the delivery of the goods after placing the order. The Customer is not given the opportunity to confirm the order until he/she indicates that he/she is familiar with and agrees to the Sparniukas.lt Store Rules. In the event that the Customer is not familiar with the Store Rules before selecting the goods, he/she must do so before confirming his/her order and the data provided therein.
- Once the Customer confirms the order, it is sent to Sparniukas.lt. The order is considered to have been placed from the moment Sparniukas.lt receives it. In this case, it is also considered that a contract has been concluded between the Customer and Sparniukas.lt. However, such a contract is considered enforceable only from the moment Sparniukas.lt receives confirmation from the Customer's chosen bank (when payment via online banking is selected) about the payment for the delivered goods; when payment is made by bank transfer, the contract is considered enforceable.
- After the Customer places an order, the Sparniukas.lt system automatically sends the Customer an email containing the ordered goods and the data provided by the Customer.
- Upon receiving a notification from the bank that the Customer has made a payment order to purchase goods from the Store, Sparniukas.lt will send a notification to the Customer to the specified email address. The moment of receipt of the notification from the bank is considered the moment of commencement of the contract between the Customer and Sparniukas.lt.
- The order submitted by the customer is stored in the Sparniukas.lt database in accordance with the requirements of the current legal acts of the Republic of Lithuania regarding the storage period of such data.
- In all cases, it is considered that the Customer, by placing an order, is familiar with and unconditionally agrees to all Store Rules, as well as all other conditions specified in the order.
- The contract is concluded and performed in the national language.
- Warranty and product pricing
- The properties of each product are generally indicated next to each product in the Store.
- Sparniukas.lt indicates, and the Customer confirms that he/she is familiar with the fact that the color, shape or other parameters of the goods specified in the Store may not correspond to the actual size, shape and color of the goods due to the characteristics of the monitor used, as well as the difference in colors in reality and in the photo, due to the scattering of light from photographic equipment.
- The Customer agrees that by placing an order electronically in the Store, he undertakes to pay the price for the goods specified in the order.
- Prices in the Store and in the order are indicated in the official national currency including VAT.
- Sparniukas.lt sells goods that meet the conditions set out in the order. In cases where the goods transferred to the Customer do not meet certain requirements of the order, the Customer agrees to first immediately notify Sparniukas.lt by phone or e-mail, and the latter undertakes to take all actions to eliminate existing defects, if such defects have arisen due to the fault of Sparniukas.lt or third parties acting on its behalf. If Sparniukas.lt fails to eliminate the defects within a reasonable period agreed with the Customer, the Customer has the right to defend his rights in accordance with the procedure provided for in the Civil Code of the Republic of Lithuania.
- Sparniukas.lt's obligations regarding goods:
6.1. Sparniukas.lt undertakes to deliver goods of appropriate quality and meeting the requirements set out in the order.
6.2. Sparniukas.lt undertakes to provide the Customer with the quantity of goods specified in the order. Sparniukas.lt is not liable in cases where the quantity of goods delivered is not accurate due to the Customer incorrectly indicating the data in the order submitted to Sparniukas.lt.
6.3. Sparniukas.lt in all cases provides the Customer with an assortment of goods that meets the criteria specified in the Order.
6.4. In cases where the order includes a certain set of items, Sparniukas.lt undertakes to provide all items included in the set of items.
6.5. The goods are delivered packaged taking into account their nature, in order to ensure that the goods are suitable for use for their intended purpose.
- Payment procedure and terms

The customer pays for the ordered goods in one of the ways indicated in the Sparniukas.lt Store. - If the Customer has chosen one of the online payment methods, he undertakes to pay for the ordered goods immediately. In other cases, the Customer loses the right to make claims for violation of the delivery terms of the goods, since the formation of the parcel of goods according to the Customer's order begins only after Sparniukas.lt receives payment for the goods.
- Statutory right to withdraw from the contract regarding SPARNIUKAS.LT goods
When you purchase goods from Sparniukas.lt, you have the legal right to withdraw from the contract:
- Information about the right to withdraw from the contract:
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party designated by you (but who is not the carrier) has received the last unit of goods. To exercise your right of withdrawal, you must inform us (MB Sparniukas, Dubysos g 1 Kauno raj. Purviškiu km. 54210 , e-mail: info@sparniukas.lt +37060926178) of your decision to withdraw from this contract by sending us a clear statement (e.g. a letter sent by post or e-mail). If you wish, you can use the attached withdrawal form, but this is not mandatory. If you submit your notice of withdrawal online, we will immediately send you a confirmation of receipt (e.g. by e-mail). You will be deemed to have met the withdrawal period if you send your notice of withdrawal before the end of the aforementioned period.
- Consequences of withdrawal from the contract:
If you withdraw from this contract, we must refund all payments we have received from you, excluding delivery costs, without undue delay and in any event not later than 14 days from the day on which we receive your notification of withdrawal from this contract. Refunds will be processed using the same payment method as you used for the initial transaction, unless expressly agreed otherwise with you. We will not charge you any fees for the refund. We may withhold reimbursement until we have received the goods back or you have provided us with evidence that you have returned the goods, whichever is the earlier. You must return or hand over the goods to us immediately and in any event not later than 14 days from the day on which you have communicated your notification of withdrawal from this contract to us. The above requirement shall be deemed to have been met if you return the goods before the end of the 14-day period. You must only cover any diminished value of the goods if the diminished value is attributable to your improper handling of the goods by checking their condition, characteristics and functioning.

(*) Delete as appropriate. The right of withdrawal expires early for contracts for packaged goods that have been unpacked after delivery and are unsuitable for return for hygiene reasons.
VII. Return of goods

The customer is given the opportunity to exchange the items delivered to him for other similar items of different dimensions, shape, color, model or completeness, or to return the goods he does not like. - The customer may return the goods by sending them back within 14 days, starting from the day after the consumer notified his decision to withdraw from the contract.
- Changes to the packaging necessary to inspect the product are not considered substantial damage or loss of commercial appearance. In all cases, the goods must be returned in the original packaging.
- The exchange or return of goods is carried out after the Customer fills out the Sparniukas.lt goods return or exchange form.
- In cases where goods are exchanged and a price difference occurs during such exchange, the Customer must pay Sparniukas.lt such price difference.
- In cases where Sparniukas.lt does not have items suitable for replacement, the Customer will be refunded the amount paid, excluding the cost of delivery.
- Goods may be exchanged or returned only if they meet the requirements set out in Section 3 of this Part of the Rules. The amount paid shall be refunded no later than 14 days from the date of signing the return form.
- All notifications to the Store must be submitted by e-mail info@sparniukas.lt or by phone No. +37060926178. The Agreement is concluded, performed and all communication between the Client and the Store takes place in the state language.
- Electronic consumer disputes can be resolved on the consumer dispute resolution platform http://ec.europa.eu/odr/
- First of all, after contacting the e-store, e-mail: info@sparniukas.lt +37060926178 and failing to reach a joint decision regarding the non-conformity, return or replacement of the product, you can submit a request/complaint regarding the product or service purchased in our online store to the State Consumer Rights Protection Service (Vilniaus g. 25, 01402 Vilnius, e-mail: tarnyba@vvtat.lt, tel. 8 5 262 67 51, fax: 8 (5) 279 1466, on the website www.vvtat.lt (also to the territorial divisions of the State Consumer Rights Protection Service in the county).
VIII. Delivery of goods

Sparniukas.lt undertakes to deliver the goods to the Customer no later than within 3-7 business days from the date of confirmation of the order execution and dispatch to the Customer. Such a term does not apply in cases where Sparniukas.lt does not have the necessary goods in stock, and the Customer is informed about the shortage of the goods ordered by him. At the same time, the Customer agrees that in exceptional cases the delivery of the goods may be delayed due to unforeseen circumstances. In such a case, Sparniukas.lt undertakes to immediately contact the Customer and coordinate the delivery of the goods. - When ordering goods, the customer undertakes to indicate the place of delivery of the goods and the person who will receive the goods.
- The Customer undertakes to accept the goods themselves. In the event that the Customer is unable to accept the goods themselves, and the goods are delivered to the specified address and based on other data provided by the Customer, the Customer has no right to make claims against Sparniukas.lt for the delivery of the goods to an inappropriate entity.
- Goods ordered in the Sparniukas.lt online store are delivered by authorized courier services. The Customer agrees on the delivery time with the authorized courier service. In cases where the Customer is unable to receive the goods at the specified time, he undertakes to immediately notify the customer service department by e-mail (find contacts in the Store section "Contacts").
- If the authorized courier service is unable to deliver the goods due to the fault of the Customer or circumstances dependent on the Customer, the courier service shall additionally coordinate a new delivery time suitable for the Customer. Repeated delivery shall be made no more than twice. If the Customer fails to accept the goods three times, the goods shall be returned to Sparniukas.lt, and the Customer shall not have the right to make claims for failure to deliver the goods on time. In addition, Sparniukas.lt shall in all cases be exempted from liability for violation of the delivery terms of the goods if the goods are not delivered to the Customer or are delivered late due to the fault of the Customer or circumstances dependent on the Customer.
- The client must immediately inform Sparniukas.lt by e-mail:
a) if, after specifying a time interval within which the shipment must be delivered, the shipment is not delivered or the couriers are more than 15 minutes late after the end of the time interval;
b) if when contacting the couriers at the specified email address, a response to the inquiry is not provided within 4 business hours or if when contacting the specified phone number, a response is not provided;
c) if the courier behaves disrespectfully or has an untidy appearance when delivering the goods;
d) in all cases, immediately inform Sparniukas.lt if the shipment is delivered in a damaged, creased or otherwise damaged package; also in cases where the shipment contains goods that were not ordered or an incorrect quantity of such goods, an incomplete set of goods, goods of the wrong size or dimensions. - In all cases where, after the couriers deliver the goods to the Customer, the package of the shipment is wrinkled, wet or otherwise externally damaged, the Customer must indicate (write notes) in the confirmation of delivery of the shipment provided by the courier or draw up a separate act regarding such defects. The Customer must implement this in the presence of the courier. If such actions are not taken, Sparniukas.lt is exempted from liability to the Customer for damage to the goods, if such damage was caused by damage to the package, which the Customer did not mark in the confirmation of delivery of the shipment.
- In cases where, upon receiving the goods, the Customer notices that the shipment does not contain the correct set of goods or the delivered goods are not of the correct size, color or other dimensions, the Customer must immediately inform Sparniukas.lt.
- Other provisions

All notifications to Sparniukas.lt must be submitted by email to the customer service department (find contacts in the Store's "Contacts" section). - The contract between the Client and Sparniukas.lt is concluded and performed in the official language.
- The design and original photos of the Sparniukas.lt website are intellectual property, the use and distribution of which without permission is prohibited. The visual content of the Sparniukas.lt website is protected by copyright and related rights of the Republic of Lithuania.
